IOPD Terms & Conditions

Licences and Participant Entry:

To participate in an IOPD Authorised event the participant must understand these conditions and agree to be bound by them. They accept that any breach of the regulations may leave them liable to prosecution.

1. It is accepted by the Signee that they knowingly intend to participate in a challenging and risky activity using mechanically propelled vehicles, (referred to as the vehicle) recognised as such under the Road Traffic Act (Off Road) Regulations 1991. The Signee accepts that dangerous conditions plus dangerous, careless and inconsiderate driving plus high speeds plus the use of amateur constructed or modified vehicles may significantly increase the risk of being killed, permanently disabled or seriously injured.

2. The Signee acknowledges that participation in an event of this type entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death or damage to themselves, to property or to third parties. It is understood that such risks simply cannot be eliminated without jeopardizing the essential qualities of this event.

3. The Signee confirms that they possess the standard of competence necessary for the type of event they are entering.

4. The Signee will before participating satisfy themselves of the preparation and condition of their vehicle. That it is suitable, safe and complies with the Regulations. Correct PPE must be worn and used in the correct manor.

5. The Signee confirms that their vehicle has no known faults which may lead to a mechanical failure which could cause Third Party damage, injury or death and will use all appropriate Safety Equipment. They accept that a ’head cam’ attachment could compromise their safety in a collision.

6. The Signee will before participating satisfy themselves of the preparation and condition of the course and its facilities and do self-certify that the margins of safety, barriers and braking areas are adequate and suitable for their degree of competence and type of vehicle for the event they have entered.

7. The Signee accepts the responsibility of monitoring all conditions that may materially change the aforementioned and they participate voluntarily and of their own free will in spite of the risks. They know they are free to withdraw at any time without penalty.

8. The Signee certifies that they have adequate insurance to cover damage caused or suffered whilst participating, or agrees to bear the costs of such damage to their vehicle.

9. The Signee accepts that none of the involved parties shall have any liability for loss or damage which may be sustained or incurred by the Signee as a result of participation in the Event. They understand that they forgo all rights to compensation from driver/rider to driver/rider liability and Insurance. Nothing in this clause is intended to or shall be deemed to exclude or limit liability permitted by law.

10. The Signee agrees to indemnify and hold harmless each of the Parties in respect of any loss or damage.

11. The Signee states that they are not taking or have not taken or drunk any substance / medication (prescribed or otherwise) which may affect their ability or judgement in the control of the vehicle.

12. The Signee states that they have no known medical condition or physical disability that would make it unsafe for them to participate or which may be adversely affected by participating.

13. The Signee confirms that should they be aware of any medical condition or injury be it age related or otherwise, prescribed medication or disability which may affect their ability to control or direct the vehicle, they will present themselves to the Chief Medical Officer or Clerk of the Course, prior to signing on for a final appraisal.

14. The Signee accepts that the Organisers may use volunteer marshals in order to keep the costs of participating in this event affordable.

15. The Signee authorises and permits the Organiser (and third parties connected with the event) to administer first aid and to authorise such other medical treatment and transportation as may be recommended by physicians, paramedics and other medical personnel, in the event of illness, accident or injury.

16. The Signee understands that their personal data is being retained solely for the purposes of staging and insuring the event and will be handled by the organisers in accordance with the IOPD data protection policy.

17. The Signee confirms that any information given is correct to the best of their knowledge and any changes will be notified to the organisers.

18. The Signee has read the rules and regulations governing the event along with any briefings or notices on the day.

19. This licence will be revoked immediately upon failure of the Signee to observe all or any of the conditions stated herein.

20. Upon receipt of the licence card it must be signed by the applicant.

Parent / Guardian for under 18s:

“My Child” covers any child under the age of 18 for whom you have legal responsibility for.

1. That the age given is correct and My Child satisfies the minimum age for the type of event being entered.

2. That I am familiar with the nature of the competition and the risk inherent therein of being killed, permanently disabled, or seriously injured and that I will inspect the course / track / circuit and its facilities before allowing My Child to participate.

3. I am satisfied and content that My Child be allowed to participate and that he / she is competent to do so. I accept that the disciplines, life skills and stimulation outweighs the increased risks of injury which can not be eliminated without jeopardising the essential qualities of the activity.

4. My Child is not taking any medication (prescribed or otherwise) and / or any substance which may affect their ability or judgements in the control of the vehicle.

5. My child does not suffer from any physical disability or medical condition that would make it unsafe for him / her to participate as a competitor or which may be adversely affected by participating.

6. It is my responsibility to ensure that My Child and I have read and understand the General Regulations of the event and any applicable Supplementary Regulations and Final Instructions and that he / she will comply with them.

7. To the best of my belief My Child possesses the standard of competence necessary for an event of the type to which his / her entry relates and that the machine entered is suitable, safe and complies with the Regulations.

8. It is my responsibility to ensure My Child is wearing the correct PPE for the event and is used in the correct manor.

9. I authorise and permit the Organiser (and third parties connected with the event) to administer first aid and such other medical treatment and transportation as may be recommended by physicians, paramedics and other medical personnel, in the event of illness, accident or injury to My Child.

Officials and Subcontractor Signing On:

1. I agree to act in an official capacity at the above-mentioned event held at the above-mentioned venue. And as such is permitted into areas prohibited to the public at large. I will go or stand only where instructed to do so.

2. I will inform the organisers immediately should I be asked to officiate in a position, or capacity, which I do not feel comfortable, confident or qualified to fulfil for any reason. And will take the initiative to be responsible for and to self certify my actions.

3. I accept that I am entering into a ‘Joint Enterprise’ with others to share or assist in a recreational activity that carries an increased level of risk over none challenging driving or riding activities which may be deemed criminal without disapplication.

4. I declare that I am a person of special character not possessed by the general public and when I enter into a Restricted Area I will wear High Vis clothing and PPE as required.

5. I declare that I am not suffering from any disability, whether permanent or temporary, which is likely to affect prejudicially the performance of my duties at this event and that I am competent to carry out my duties.

6. I will familiarise myself with all flag, radio and all event protocols.

7. I accept that I knowingly intend to be involved with a challenging and risky activity using mechanically propelled vehicles, recognised as such under the Road Traffic Act (Off Road) Regulations.

8. I accept that dangerous conditions plus dangerous, careless and inconsiderate driving plus high speeds plus the use of specially constructed vehicles may significantly increase the risk of being killed, permanently disabled or seriously injured and enter into this venue fully aware of the inherent risks of my decision to be involved in a high risk activity.

9. I agree to attend safety briefings or accept that I am fully conversant with the safe operational procedures of this event.

10. I will not enter onto the course until I am confident that it is safe to do so under the direction of the Clerk of the Course.

11. I accept that I have a ‘duty of care for myself’ as it will not be reasonably practicable for the surface of the traffic routes to be free from holes, slopes, uneven or slippery surfaces and obstructions.

12. Persons under 18 years of age must be signed on with a parent or guardian and accompanied and instructed by an experienced adult and observe and obey all instructions given by other officials.

13. I understand that my personal data is being retained solely for the purposes of staging and insuring this event and will be handled by the organisers in accordance with the IOPD data protection policy.

14. I certify that I have adequate insurance to cover any damage caused or suffered while entering into restricted areas or participating or I agree to bear the costs of such damage. Assuming that it is not as a result of the negligence of the Organisers.

15. I understand that as a photographer, medic or other subcontractor I must also have adequate Public Liability Insurance.

Passengers:

1. It is accepted by the Signee that they knowingly intend to participate in a challenging and risky activity using mechanically propelled vehicles, (referred to as the vehicle) recognised as such under the Road Traffic Act (Off Road) Regulations 1991. The Signee accepts that dangerous conditions plus dangerous, careless and inconsiderate driving plus high speeds plus the use of amateur constructed or modified vehicles may significantly increase the risk of being killed, permanently disabled or seriously injured.

2. The Signee acknowledges that participation in an event of this type entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death or damage to themselves, to property or to third parties. It is understood that such risks simply cannot be eliminated without jeopardizing the essential qualities of this event.

3. Participation in this activity is purely voluntary and if at any time I become concerned for my safety I will immediately ask the driver to slow down or stop and take me out of any activity.

4. The signee will use all appropriate Safety Equipment.

5. The Signee states that they are not taking or have not taken or drunk any substance / medication (prescribed or otherwise) which may affect their ability or judgement in the control of the vehicle.

6. The Signee states that they have no known medical condition or physical disability that would make it unsafe for them to participate or which may be adversely affected by participating.

7. The Signee confirms that should they be aware of any medical condition or injury be it age related or otherwise, prescribed medication or disability which may affect their ability to control or direct the vehicle, they will present themselves to the Chief Medical Officer or Clerk of the Course, prior to signing on for a final appraisal.

Definitions:

An authorised Track Day is defined by The IOPD as a non-competitive event using a pre-defined course or route.
